When is a pool fence required in WA?
In Western Australia, a pool fence is mandated by law for any residential swimming pool or spa with a water depth greater than 300mm. The regulations are designed to ensure the safety of residents – particularly young children – and the local government is responsible for enforcing these regulations, with non-compliance resulting in substantial fines.
Current WA pool fencing regulations
It’s crucial for pool owners in Western Australia to adhere to the following pool fence regulations to ensure the safety of their premises and avoid legal repercussions.
- Height: The fence must be at least 1200mm tall above ground level.
- Gates: Gates must be hung so they swing away from the pool area because children can use their weight to push a gate forward. The gates must also close automatically with a self-locking latch placed at least 1500mm above ground level or behind a latch shield.
- Climbable Objects: There should not be any climbable objects placed within Non-Climbable Zones of the fence (1200mm), such as trees, furniture, BBQs, etc.
- Boundary Fences: If there are any boundary fences used as part of the pool fencing, they should be standing vertically and be leaning no more than 15 degrees.
- Owner Responsibilities: All swimming pool owners in Australia have responsibilities, accountability, and a specific duty of care in terms of pool safety compliance.
Existing pools vs new pools

Pre-May 2016
Pools installed before May 2016 should comply with the Australian Standard AS 1926.1-1993 for swimming pool safety and fencing. The barriers for these pools may consist of any fence, wall, or gate as long as each part complies with the relevant requirements stipulated in the Australian Standard AS 1926.1-1993.
Barriers
Pools built prior to May 2016 require an isolation barrier between the pool and the residence. The barrier can be made of any materials as long as they’re durable and all the components comply with the AS 1926.1-1993 requirements, with a particular focus on strength and rigidity of openings.
Additionally, all parts of a barrier must be at least 1200 mm from the top to the finished ground surface, as measured on the outside of the barrier. If the barrier has horizontal members, the highest of the low members must be at least 1100 mm from the top of the barrier.
Climbable Objects
Placing climbable objects near a swimming pool poses significant safety risks, inviting the potential for accidents and unauthorised access to the water. For this reason, it’s crucial to comply with the barrier requirements as well as meet certain conditions on the inside and outside of the barrier.
Objects capable of serving as a foothold, enabling young children to climb over, should not be positioned within 1200 mm of the top of the barrier. This includes items such as BBQs, garden retaining walls, outdoor furniture, water features or ornaments, and trees or shrubs.
For barriers featuring vertical gaps wider than 10 mm but not exceeding 100 mm, it’s essential that any significant horizontal surfaces on the inside of the barrier aren’t placed any closer than 300 mm from each other. This ensures that these horizontal surfaces cannot support climbing of the barrier.
Boundary Fences
The boundary fence should be a minimum of 1200 mm in height and must be non-climbable, with no objects that can be climbed within 1200 mm of the top of the fence. This requirement applies to either the pool side or the neighbour’s side of the fence. Alternatively, pools constructed before May 2016 may adhere to the post-May 2016 barrier standards.
Post-May 2016
Private swimming and spa pools installed in or after May 2016 are required to adhere to the updated standards referenced in the Building Code of Australia (BCA), which includes Australian Standard 1926.1-2012 (AS 1926.1:2012) which details the minimum technical requirements that must be applied to swimming and spa pool barriers. The BCA also includes Australian Standard 1926.2.2007 (AS 1926.2-2007) which details the requirements for the location of barriers.
This means that for new pools built after May 2016, a building permit is required before installing the pool, ensuring that the design complies with the Regulations and Building Code of Australia.
